Personal data (hereinafter referred to as "data") will only be processed by us within the scope of necessity and for the purpose of providing a functional and user-friendly internet presence, including its contents and the services offered there. 

According to article 4 number 1 of the regulation (EU) 2016/679, i.e. the data protection basic regulation (hereinafter referred to as "DSGVO"), "processing" means any operation carried out with or without the aid of automated procedures or any such series of operations in connection with personal data, such as the collection, recording, organisation, arrangement, storage, adaptation or modification, reading, retrieval, use, disclosure by transmission, dissemination or any other form of provision, comparison or linkage, restriction, deletion or destruction. 

With the following data protection declaration we inform our users and affected parties in particular about the type, scope, purpose, duration and legal basis of the processing of personal data, insofar as we decide either alone or together with others on the purposes and means of the processing. With regard to the data processing described in more detail below, users and data subjects have the right to  

• obtain confirmation as to whether data concerning them are being processed, information on the data processed, further information on the data processing and copies of the data (cf. also Art. 15 DSGVO); 

• the rectification or completion of inaccurate or incomplete data (cf. also Art. 16 DSGVO); 

•  to the immediate deletion of the data concerning them (cf. also Art. 17 DSGVO) or, alternatively, if further processing is required pursuant to Art. 17 para. 3 DSGVO, to the restriction of processing pursuant to Art. 18 DSGVO;  

• to receive the data concerning them and provided by them and to transfer these data to other providers/responsibles (cf. also Art. 20 DSGVO); 

• upon complaint to the supervisory authority if they are of the opinion that the data concerning them are being processed by the provider in violation of data protection provisions (cf. also Art. 77 DSGVO). 

 

In addition, we are obliged to inform all recipients to whom data has been disclosed by the provider of any rectification or deletion of data or the restriction of processing that takes place pursuant to articles 16, 17 para. 1, 18 DSGVO. However, this obligation does not apply if such notification is impossible or involves disproportionate effort. Notwithstanding the foregoing, the user shall have the right to obtain information about such recipients. 

Users and data subjects also have the right under Art. 21 DSGVO to object to the future processing of data concerning them, provided that the data are processed by the provider in accordance with art. 6 para. 1 lit. f) DSGVO. In particular an objection to data processing for the purpose of direct marketing is admissible. 

 

III. Information on data processing 

 

When using our website, processed data will be deleted or blocked as soon as the purpose of storage no longer applies, the deletion of the data is not opposed by any legal storage obligations and no other information on individual processing methods is subsequently provided. 

Server data 

For technical reasons, in particular to ensure a secure and stable internet presence, data is transmitted to us or to our web space provider via the internet browser. With these so-called server log files, the type and version of your internet browser, the operating system, the website from which you switched to our internet presence (referrer URL), the website(s) of our internet presence which will be visited by the users and affected persons, date and time of the respective access as well as the IP address of the internet connection from which the use of our internet presence takes place are collected. This data is stored temporarily, but not together with other data of our users. 

This storage takes place on the legal basis of Art. 6 Para. 1 lit. f) DSGVO. Our legitimate interest lies in the improvement, stability, functionality and security of our internet presence. 

 

The data will be deleted after seven days at the latest, as long as no further storage is necessary for evidence purposes. Otherwise, the data shall be completely or partially excluded from deletion until the final clarification of an incident. 

Cookies 

a) Session cookies/session cookies 

We use so-called cookies with our internet presence. Cookies are small text files or other storage technologies that are stored on your end device by the internet browser used by our users. These cookies process certain user information to an individual extent, such as browser or location data or your IP address. 

This processing makes our internet presence more user-friendly, more effective and safer, as the processing enables, for example, the reproduction of our internet presence in different languages or the offer of a shopping cart function. 

The legal basis for this processing is Art. 6 Para. 1 lit. b.) DSGVO, insofar as these cookies are used to process data for contract initiation or contract execution.

On our website we use Google Maps to display our location and to create a route description. This service is provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, hereinafter referred to as "Google".

Use of the Sirvoy Reservation System Ltd 

 

  

 

Plugins of the Sirvoy Reservation System Ltd. are integrated from our website. The operating company of Sirvoy Reservation System is Survey Ltd, 13 Upper Baggot Street, Dublin, Ireland. 

This is software for recording data that is used to create and process reservations and to process orders. On our website https://www.list-five.de, Sirvoy Reservation System is used to make a direct reservation or reservation request online. The type and scope of the data requested can be found in the corresponding booking form. Sirvoy Reservation System Ltd. works for us as an order data processor. 

This data is collected, processed and used exclusively for the implementation and processing of the contractual relationship (accommodation contract) and hostel stay based on the reservation.  

The underlying legal basis results from Art. 6 Para. 1 S. 1 lit. b) DSGVO. Our legitimate interest lies in the implementation of the execution of the contract and are necessary in this respect. The data is stored for the accelerated handling of future inquiries and contract conclusions. They will not be passed on to third parties after the conclusion of the contract. Tax and commercial retention periods will continue to be observed.

Smart Home

Smart home systems (Homatic,Iobroker) are used in our inn. We want to point out that no private data is collected. There is no linking of the smart home data with the booking data. The smart home systems are not connected to the Internet. Furthermore, the collected Smart Home data is managed exclusively on our own servers.
The underlying legal basis results from Art. 6 para. 1 p. 1 lit. b) DSGVO. Our legitimate interest lies in a comfortable performance of the booked service while reducing energy consumption, emissions, as well as costs. Furthermore, retention periods under tax and commercial law are observed.
 

 

Data Security 

 

Personal data of users and affected persons are transmitted in encrypted form via SSL over the Internet. 

We secure our website and other systems through technical and organizational measures against loss, destruction, access, alteration or distribution of your data by unauthorized persons. Access to your customer account is only possible after entering your personal password. Users and affected parties should always treat your access information confidentially and leave our site with a logout or close the browser window when you have finished communicating with us, especially if you share the computer with others. 

We take numerous technical and organizational measures to protect your personal data against accidental or unlawful destruction, loss or alteration and against unauthorized disclosure or access. 

Nevertheless, Internet-based data transmissions, for example, can always have security gaps, so that absolute protection cannot be guaranteed. For this reason, each person concerned is free to transmit personal data to us by alternative means, such as telephone.
